Outline of Final Research Achievements |
With regard to how criminal liability should be determined in the event of an accident involving an automated vehicle, in particular, we obtained certain knowledge on (1) how criminal liability should be pursued in traffic crimes, (2) how liability should be pursued in "specified automated driving," which was newly established in the Road Traffic Law, (3) legal issues regarding the maintenance and collection of related data in automated driving, which is essential for making these determinations, and (4) cyber security and information collection, which can be problematic in the connected car. In this research, we were involved in study groups of related organizations such as National Police Agency, Ministry of Economy, Trade and Industry, NISC Cyber Security Council, etc., and actively incorporated the results of these meetings.

Academic Significance and Societal Importance of the Research Achievements |
本研究では、レベル4の自動運転の実証研究が開始された現状において、交通事犯における従来の法的責任追及のあり方が、将来にわたり大きく異なっていく可能性があるとの認識のもと、特定自動運行という新たな法的枠組みにおける関与者の責任分担の法的な分析、さらに、運行記録(データ)に依存した捜査が行われることが想定されるなか、サイバーセキュリティの視点も踏まえて、そのデータ収集に関連する法的課題を整理、分析した。以上の研究に基づき、今後の関連分野における議論に資することを目的とした点において、その学術的意義や社会的意義が認められると考えている。
