Outline of Final Research Achievements

This research attempts a cross-sectional examination of fashion design protection under various intellectual property law systems, taking into account not only the legal system but also the actual state of the fashion business. Specifically, in regard to the current state and ideal state of fashion design protection, which is not compatible with registered design rights protection that require application and registration, protection under non-registration systems (Unfair Competition Prevention Act Article 2, Paragraph 1, Item 3, Article 2, Paragraph 1, Items 1 and 2, trademark right, and copyright) was examined cross-sectionally, taking into account the division of roles.
In particular, I focused on the examination of protection under Article 2, Paragraph 1, Item 3 of the Unfair Competition Prevention Act, through a comparison between the UK law, and submitted my doctoral thesis (currently in preparation for publication).
