Outline of Final Research Achievements |
In this study, it was investigated whether the requirement to specify counts (the criminal procedure act §256(3)) in child sexual abuse cases could be met by a certain period of dates and times, analogous to the approach used for the relationship of evidence and proof structure and the specification of counts in cases involving self-use of narcotics. The findins are published in the article "Justification of specifying counts with a certain period of dates and times in child sexual abuse cases". In addition, it was investigated how to enhance the overall criminal procedure for obtaining and preserving testimoneis from abused children. The findings are documented in the publication titled "the New Forensic Interviewing Guideline". (the researcher is one of the authers.)

Academic Significance and Societal Importance of the Research Achievements |
本研究は、従来十分には言語化されていなかった覚せい剤自己使用事案における証拠・立証構造の特徴と訴因の特定の程度との関連性を明らかにし、それを他の事案類型にも応用することが可能であることを明らかにした点で、訴因の特定に関する議論を深化又は促進させるものである。また、その過程で明らかとなった手続上の課題についてもその改善策を具体的な形で提示しており、より子どもの利益に適った事案対応の実現に資するものであり、実際に本研究の成果に即した実践例もみられるようになっている。
