Outline of Final Research Achievements

The generality of law is not clearly prescribed in the Constitution but accepted by the dominant theory and practice. I researched it by referencing precedents and theories in Japan and Germany. It is proved that the dominant theory and precedents consider individual und concrete law to be constitutional allowed and minimize the meaning of the generality of law in Germany. It is also proved that practice in court and legislation treats the generality of law deal with a confusing problem, because theories didn’t organize sufficiently its concept in Japan.

Academic Significance and Societal Importance of the Research Achievements

我が国の通説的見解は、「法律の一般性」を当然のように承認してきたが、本研究を通じて、「法律の一般性」に関する概念整理や法的意義の分析が不十分であることなどが判明した。この点について議論が豊富なドイツにおいては、判例も学説も、「法律の一般性」の意義を局限化している。以上のような国内外の議論状況を踏まえると、日本の学説・実務も、「法律の一般性」の位置付けを消極的な方向で再考すべき段階にあることが本研究によって判明したと言える。
