Outline of Final Research Achievements |
This study focused on the impact that human rights issues related to climate change have had on modifications of public participation in international negotiations. In other words, this study focused on the relationship between the emergence of human rights issues and changes in the mode of public participation. The study analyzed the correlation between the increase in the identification and sharing of human rights issues related to climate change and changes in public participation in various treaty bodies. Additionally, it elucidated the impact that the emergence of those human rights issues since the 2000s has had on the participation of non-state actors in international negotiations and on ensuring transparency. Furthermore, the study revealed the reasons for the variation of patterns in public participation among treaty bodies under the influence that the human rights approach has had on public participation.

Academic Significance and Societal Importance of the Research Achievements |
人権アプローチの公衆参加への影響と、条約体間で公衆参加態様の変化に異同が生じる理由を明らかにする課題について、条約体制間相互作用による国際人権基準の形成課題という新たな理論的視点を提示した。これにより、相互作用に参加する構成員の立場を認識し、国内外の討議・説得場面、主体、説得対象としての内容等、相互作用の結果に影響を与える要素を把握可能とし、人権規範や公衆参加に関する規範の相違が国際法学上もつその意義を明らかにした。伝統的国際法では、国家同意が法形成における排他的要素とされたが、国際社会の普遍的価値である人権実現に関する各国家の役割が、条約体制間相互作用によっても画定されることを示した。
