Outline of Final Research Achievements

This study has examined “Free Will Skepticism,” which has gained a growing presence in Anglo-Saxon theories of free will and the justification of punishment in recent years, by analyzing, among others, Rejecting Retributivism (CUP, 2021) by Gregg D. Caruso, a leading contemporary proponent of Free Will Skepticism, and by translating some foundational literature on the basic theory of criminal responsibility. As a result, it became clear that, although compatibilism tends to be perceived as the de facto only position that can be consistent with the criminal justice system in Japanese criminal law studies today, in fact, free will skepticism can also be fully consistent.

Academic Significance and Societal Importance of the Research Achievements

もし人間に自由意思がなかったとしたら、刑事責任ないし刑罰の制度はもはや維持できなくなる、と一般に考えられている。これは、哲学や刑法学において自由意思が活発に論じられてきたことの、大きな理由の一つである。ところで、そうなると、人の自由意思をおよそ否定する立場である自由意思懐疑論は、必然的に、刑罰制度を廃止すべきとの(いわば、極端な)結論に至りそうである。それゆえ、この立場は、近年の刑法学ではほぼ顧みられていない。しかし、本研究は、この立場の支持者らが展開する議論を注意深く再検討することで、その主張にはむしろ、現在の刑罰制度の改善に向けた、現実的・建設的な指摘が多く含まれていることを明らかにした。
