| Outline of Annual Research Achievements |
本研究は古代ローマ法における民事訴訟の制度と実態を、古代ギリシア、とりわけアテナイの民事訴訟をパラレルなものとして比較することにより、両者の類似性と相違点を明らかにする我が国ではオリジナルな試みである。また、ローマ帝国下のギリシア、エジプト地域のローマ法の実態を分析する研究は国際的に見て行われているが、古典ローマ法と古典ギリシア法のパラレルな研究は、内外においてほとんど例を見ない。4年間の全研究計画において最終年度にあたる本年度は、以下のような研究を行った。
第一に、平成25年度末から26年度初めにかけて、学術振興会短期招へいプログラムで来日中のグラスゴー大学ローマ法教授メツガー先生と本科研費で同時期に招へいしたブラウン大学スカフーロ教授を交えて、本科研費により「ローマ法とギリシア法の比較ー訴訟の観点から」と題するシンポジウムを開催した（於東京大学）。このシンポジウムでは、とくに弁論資料と法学資料の比較という資料論の論点と、訴訟当事者（奴隷の役割）に焦点を合わせて、徹底的に比較を行った。
第二に、平成26年4月に、来日中のラテン弁論術研究者ポウェル教授およびギリシア法研究者ルビンシュタイン教授（ともにロンドン大学教授）を本科研費で招へいし、両者とかこんで、第一のシンポジウムと同じ観点、すなわち、資料論と訴訟当事者に焦点を合わせて国際シンポジウムを開催した。いずれもその成果を公表する予定である。
第三に、上記の両シンポジウムから明らかになったことは、資料論として、ローマ法資料を言語学的観点から見た場合、法律家が考えるほど、ローマ法言語は特殊ではないということ、そして、訴訟当事者は従来考えられていたようにに決して市民のみではなく、奴隷や外人を含む多様な存在であったことである。
