Research Abstract |
This research program analyzed the theoretical foundations for the prevention of torts through the civil liability law system in Japan, especially through (a) the injunction system, (b) strict liability law, (c) punitive damages in the USA and (d) the so-called "Gewinnabschoepfungsansruch" in Germany (Systems (c) and (d) do not exist present in Japan). This research explored the character of each system and clarified the relationships existing among them. Additionally the theoretical possibility and political suitability of Introducing systems (c) and (d) in Japan were examened.
