Outline of Annual Research Achievements

今年度はまず，Kent Greenawalt教授のSpeech, Crime, and the Uses of Language (1989)を読み込み，定義付け衡量と保護領域論に関わる部分をメモし，検討した。第2に，定義付け衡量論と保護領域論を展開しているその他の文献を収集し，これまでに検討したFrederick SchauerとKent Greenawaltへの評価，それらとの異同を調査した。特に，Cass Sunstein, Democracy and the Problem of Free Speech (1995)がこの点について詳しく論じていたため，深く読み込んだ。また，この主題に関わるStanford Law Review, vol. 53(4)のJed RubenfeldとEric Posnerの論争を読み，分析，検討した。そのほか，Laurence Tribe, John H. Ely, Melville Nimmer, Steven Shiffrin, Kenneth Karst, Daniel Farber, Larry Alexanderの論文を精読し，関連部分をメモした。

Reason

26年度は上記のとおりGreenawalt，及びSchauer，Greenawaltに関連する論者の議論を調査する予定だったが，ほぼ当初の予定通り研究が進行した。

Strategy for Future Research Activity

今後はRoberts Courtの定義付け衡量に関わる判例を，過去の関連判例に照らして詳細に分析する作業に入る。今後は多数の判例を収集し，整理していく必要があるため，研究補助を雇用する等の工夫を行いつつ，研究課題を遂行していく。なお，今後の研究計画については特に変更を予定していない。

Causes of Carryover

年度末に消耗品費に少し余裕を持たせていたが，予想に反して使用額が少なかったため，若干の余剰がでてしまった。
