| Outline of Annual Research Achievements |
混合法に関する総論的、方法論的検討をすすめつつ、信託について具体的論点をめぐって個々の研究を進めた。以下の国際研究会等で発表を行った。科研費研究メンバーが複数同時に参加した場合が多い。
１、東欧ローマ法・民法研究会Sommer Seminar, Belgrade; Conferences “Mixed legal system in Japan”at Novi Sad and Belgrade 松本、葛西；２、ジュネーヴ国際研究会Odysseus and the Odyssey, Fondation Hardt 葛西、吉村、松本；３、ケンブリッジ日英研究会Writing Japanese Law in English ― A Conference on Comparative Approaches to Japanese Law and Common Law-, Clare Hall 葛西、溜箭、松本；４、比較国制史研究会 松本；５、ベオグラード、ドーニャゴリツァ研究会 Role of Law in the Era of Globalization, Donga Gorica, Pod Gorica (Montenegro);International Conference of Japanese and Serbian Scholars “Comparative Law, Codifications, Customary Law, and Mixed Legal Systems", Belgrade 葛西、溜箭、松本
一方では、古代法（ローマ法信託遺贈、ギリシアにおける相続をめぐる訴訟）との比較において信託の考察を進めた。他方では、バルカン法（セルビア、クロアチア、モンテネグロ）との比較の試みを通して、信託と相続、相続と慣習法の関係を結ぶ新たな視座が得られた。

Reason
科研メンバーによる、トニー・オノレ信託法研究のための研究会は、より頻繁に開催することが望まれるが、科研メンバーの複数が出席する国際研究会への参加が活発に行われ、これを通して、研究の進展があった。特に、予想を上回る進展をみたのは、東欧と日本の法制の比較である。混合法を論じる際に、広義の混合概念を採用すると、慣習法を正面からとらえなければならない。この点の方法論的試みを具体的に推進することができた。同時に、多くの資料的発見をともない、今後検討すべき議論の切り口がいくつも獲得された。

3月に予定していた出張（研究会）が、他の予定との関係で実施不可能となり、次年度に改めて実施することとなったため。
