Research Abstract |
This research aimed to investigate the commonality of civil law of East Asian countries (Japan, Taiwan, Korea, China)and the possibility of the formation of an East Asia Legal Family. The research results are to be summarized as follows. 1.Korean jurisprudence and civil law is continuously influenced from Japan, and also from German after World War II. 2.We also researched the revised Korean Company Law and the draft of new Korean Civil Code. 3.As for law on unjust enrichment, Korean law is mainly based on Japanese law, while the law of other countries (Manchukuo, Taiwan) are influenced by Japan, Germany, and Switzerland. 4.Inheritance law of Taiwan is under strong influence of theories in Japan and of German law. 5.Tort law of Korea, especially the field of personal injury, is very similar to that of Japan save several differences based on the difference of a role of social security. 6.These researches tell us that the law of East Asian countries are under strong influence of the law of European countries and Japan. The influence from case law countries is very weak. We should be able to classify the law of China, Korea, Taiwan, and Japan under the name of East Asia law in the future.
