Research Abstract |
This research tries to illuminate the place of the referendum in the Modern Constitution by surveying the states and the circumstances of the referendum in the French Modern Constitution. In the French Constitution, the referendum was totally rejected by the Constitution itself under the third republic, it was limitedly introduced under the forth republic and the referendum has developed under the fifth republic. But French referendum shows the danger of "referendum as administrative state tool", which in only a type of the referendum in modern constitution.
