Research Abstract |
The research result has composition of part I ("The supervisor system for the private sector under the Federal Data Protection Act in 1990") and part II ("Revision of the Federal Data Protection Act", and "Modernization of the Data Protection Law"). In Part I, the supervisor system in the German Federal Data Protection Act in 1990 is analyzed and examined especially paying attention to the efficiency of the protection of personal data in a private sector. Consequently, the following things become clear. That is, it is saying that this system has dual structure of self-control of an entrepreneur and the external control by competent authorities (supervisory authorities), and external control had been strengthened and others. In Part II, the main revision matters of the revised German Federal Data Protection Act (May, 2001) and the preparation of government for "the next revision" ("Modernization of the Data Protection Law") are analyzed and examined. Consequently, it is shown that the shift from concentrated types of public control (control by supervisory authorities) to distributed types of control and self-control by the private enterprise processing or using personal data is progressing.
