Outline of Final Research Achievements |
This research aims to explore a new constitutional theory that replaces the "autonomy of faculty" theory. In order to achieve this objective, this study focuses on discussion in France as the main consideration subjects, such as (1) examination of representative theories, (2) analysis of Conseil d'Etat precedents, (3) comparison between "independence of professor" and "independence of justice" . As a result, we could mainly clarify the following points. (1) It is autonomy in the whole group of researchers, not autonomy of each university, that French judicial precedents and theories focus on. (2) Especially for faculty personnel affairs, evaluation and judgment by academic experts is strictly required.
