Research Abstract |
During the period of this research, the negotiations of the United Nations convention on the rights of persons have made a great progress. In the fiscal years of 2004 and 2005, five sessions of the Ad Hoc Committee (AHC) were held. The Working Group draft, which was prepared at the Working Group in January 2004, has served as the basis for the following negotiations. The seventh session of AHC, which met in January/February 2006, revised the chair's draft and produced the latest draft, which is called the "working text". The negotiations are entering the final stage. This research has made it clear that an analysis from the perspectives of both disability studies and international human rights law is essential. Major components of disability studies, namely, the social model, the cultural model, and the participation of disabled people, are well reflected in the draft convention. From the perspective of international human rights law, comparison between this proposed convention on disability and other conventions, including the international convention on the elimination of all forms of discrimination against women and the convention on the rights of the child, is critical, since gender, women with disabilities and children are major issues of the proposed convention. This research project also carried out studies on the international and domestic system regarding human rights. Particularly, a research on the domestic system is indispensable. One of the major achievements of this research is the timely sharing of information on the on-going negotiation process through academic meetings and web sites. It is necessary to continue to study the final stages of the negotiation of this historic convention on disability without delay, further analyze the draft convention and consider effective national implementation.
