Outline of Final Research Achievements |
It was confirmed that the fact that the information gathering activities conducted by the investigative agency could extend to administrative police activities is common to both Japan and Germany. The basis for this consists of gathering and storage of information. Of these, in Japan, the emphasis is placed only on regulations concerning information gathering, and there are no legal regulations regarding storage. On the other hand, in Germany, legal regulations concerning the storage of information are in place, and active discussions are taking place. In this research, we conducted a comparative study focusing on the storage of DNA-databases and the preliminary storage of information concerning the telecommunication, and found that while the legal system in Germany is helpful for Japan, the problems were pointed out there as well.

Academic Significance and Societal Importance of the Research Achievements |
研究期間中、刑事訴訟における情報収集を取り巻く状況は、明確な変化をみせている。本研究では、情報の有する価値に着目し、国家機関による情報保存の問題性を指摘した。学術的な面では、最大判平成29年3月15日に代表される近年の判例の分析を通じて、個人情報の取得に関する近年の実務の状況を分析した。また、国際的な面では、ドイツの研究者との学術交流を通じ、協力関係を確固たるものとすることができた。今後も学術協力を通じて、より発展的な研究を実施する予定である。
