Research Abstract

EU法において最近非常に拡大傾向にある、相互承認原則は、国際私法の分野にも影響を及ぼしつつある。準拠法選択と外国判決の承認という、国際私法における2つの方法の観点から見ると、相互承認原則は承認という名称は付いているものの、判決承認に分類されるわけではない。しかしながら、むしろ視点を変えて、法廷地国が双方主義的な準拠法選択規則及び外国判決承認ルールで渉外的法律関係を規律し尽くそうとしているのに対して、一定の場合には例外的な救済が必要であり、その1つの現れが相互承認原則ではないかと思われる。
