Research Abstract	本研究は、ドイツ連邦憲法裁所における<ゆらぎ>と見られる判例傾向を分析することを主たる目的とした。具体的には、基本法の重要な解釈が問題になっており、かつ国民の注目度も高いにも関わらず、あえて憲法解釈の重要な部分についての判断を回避する判例傾向を、他国と比較しながら研究した。研究の結果、価値多元化社会において憲法裁判所が一定の判断を下すこと自体に大きな価値対立を生むといったような困難さが、このような傾向を引き起こしている原因ではないかという結論に至った。
