Research Abstract |
The first mission of this study is the research of the law in the United States. We must show the change of the sharing of the responsibilities between the nonprofit organizations and their stakeholders, and the reason of this change. The second mission is to apply the fruit of the first mission to the study of Japanese law. There were a lot of difficulties in the process of illustration of the changes of the law in the United States, but finally, it became clear that the limitations of tort liabilities by case law/of the organizations were replaced by the limitations by statutes/of the stakeholders. It is still not sure why this change happened, but we can guess that the organizations became well-off, and this effected to the change. If so, through the research of disputes in Japan, we can find that the enough solvency of the organizations is the presupposition of the limitations of stakeholders. Therefore, we can say that this study is enough productive.
