Research Abstract

意図(特に殺意)および「合理的疑い」に関する、裁判員のしろうと理論について検討した。その結果、殺意の認定については、裁判員に独特の判断傾向があること、評議において、裁判官側が裁判員役の役割を提示せずに、裁判員側の主張を先に聞いた場合も、裁判官側が先に、定義等をしない場合も裁判員が納得する程度には違いがないことが示唆された。このことは、裁判員評議の運営において示唆を与えるとともに、学術的にも、市民の判断の特徴を考える上で有用であると考えられる。
