３つの研究チームを設け、第1に「子の養育保障システム」として、①離婚後の親権・監護権の共同化、②面会交流の継続的実施を保障する仕組み、③養育費の分担と履行確保の仕組みを取り上げ、第2に「子の意思反映システム」として、④子の意見表明の保障、⑤子への情報提供、⑥子どもの手続代理人の活用を取り上げ、第3に「合意解決促進システム」として、⑦協議離婚、家事調停各段階の合意解決の促進、⑧DV事案への対応、⑨国際離婚とハーグ条約への対応を取り上げ、実務や隣接諸科学等からの検証を受け、現実的な「親の別居・親の離婚における子どもの権利保障システム」を構築する。

| Outline of Final Research Achievements |
In order to guarantee children's rights in the event of parent's separation or divorce, we proposed a system that enables parents to consider their children's thoughts and ideas and to create a childcare plan for their children by guaranteeing the child's right to grow and develop from a basic perspective and by guaranteeing the child's right to express his or her opinions. The joint custody system after divorce was positioned as a code of conduct that would make these issues common knowledge in society. As a result, we published "Guaranteeing Children's Rights and Parental Divorce" (Shinzansha). In order to enhance the effectiveness of visitation support by third-party organizations, Association of Child Contact Support Japan was established to certify support groups. Through exchanges of opinions with support groups, standards, guidelines, and training materials were developed to indicate the appropriateness of support, and a certification system was implemented on a trial basis.

| Academic Significance and Societal Importance of the Research Achievements |
学術的意義は、子を保護の対象から権利の主体へと子ども観を転換し、離婚後の親権・監護権の行使、面会交流、養育費の履行など子の養育に関する問題を、子の意見表明権の保障を通じて子の意思を反映させ、子が主体となって親の合意による解決を促進する具体的な仕組みを提案したことである。社会的意義は、父母の葛藤が高く、子と別居親との面会交流を自主的に実行できない場合に当事者を支援する面会交流支援団体の支援者と研究者の意見・経験交流の場である面会交流支援フォーラムや面会交流支援研究会を立上げ、これらのネットワークに基づいて支援団体の認証制度を設立し、試行実施をしたことである。支援団体の全国展開の可能性が生まれた。
