| Outline of Research at the Start |
本研究では、以下の3点を解明することを目的とする。第1に国際的・地域的人権レジームを反映して、各国レベルで低所得層、移民労働者、先住民、女性等社会的弱者の権利を保護するためにどの様な制度や政策が制定されたのか。 第2に21世紀に入り反グローバル化言説が強まる中で、それがどの様に変容しているのか。第3にそうした政策や制度の持つ実効性がどの程度あり、どの様な問題が残されているのか、またその背景にどの様な要因があるのか。分析する時期は、1990年代の新自由主義改革を経てその政策の見直し、さらに再度のゆり戻しが起こっている現状を対象とする。

| Outline of Final Research Achievements |
There are various human rights problems in contemporary Latin America. In this study, human rights were analyzed not only for liberal rights aspects but also for various social rights aspects. In previous researches, studies on human rights and related policies from the perspective of rights are increasing, but most of them are one country studies. On the other hand, in this research, We have broadened our perspective from one country research and tackled the problem of how the international human rights regime protects the human rights of people in Latin America and its limits. The target countries are Mexico, Costa Rica, Venezuera, Peru, and Argentina, and the thems are diverse, including women, immigrants, indigenous peoples, political rights, and the rights of the elderly. The current state of the international human rights regime has a declaratory character, but it influences national some policies.

| Academic Significance and Societal Importance of the Research Achievements |
本研究の意義は、それまで一国研究で自由権が主たる研究対象であったラテンアメリカの人権研究に関して、国際人権レジームという分析の視点を取り入れた点である。ラテンアメリカにおける人権の保護に関る諸制度の整備と実践は、一国レベルで実施されてきた。他方自由権および社会権の保護に関する国際的、またラテンアメリカ地域における条約や宣言からなる国際人権レジームが成立している。本研究では、国際人権レジームが実質的に各国の人々の人権を如何に保護する機能を果たしているのかを実証的に検討している。本研究では、国際人権レジームは主として宣言的な役割を果たしているが、各国の制度形成へも一定の影響をがあることが判明した。
