本研究は、主要国の国内法制を比較検討することを足がかりとして、①どのような制度間調整が国内・国際レベルにおける選択肢となるか比較分析した上で、②異なるレベルの国際制度のどこで(またはどう協働して)規律することが最適か、実証的に検討する。これらを通して、国内制度と相互連関しながら多元的・多層的に併存する複数の国際制度間の新たな調整の可能性を示す。

| Outline of Final Research Achievements |
We focused on several of the WTO rules such as anti-dumping (AD), subsidies and countervailing duties (CVD) and the rules of origin (ROOs) to investigate the normative interactions between them within the framework of the World Trade Organization (WTO) Agreement system. We took on several distinctive disputes to analyze how these rules relate to one another to cast light on impending legal issues.

| Academic Significance and Societal Importance of the Research Achievements |
規範の「迂回」とは、通常とは異なる方法をとることでもって当該規範の適用を免れ、もって当該規範の目的と機能を損なう行為を指す。これを無制約に許せば、規範の実効性が損なわれることになる。他方で、人為的な操作を加えたり通常とは異なる方法をとったりする点を除けば少なくとも形式的には適法な行為である以上、それに対する過剰規制を避ける必要もある。このような意味において、「迂回」をどのように規律するかは国際法と国内法に共通する難問であることを明らかにした。
