EdTech(Educational Technology)を活用した教育が広まり、教育効果などに期待が集まる一方、そこでは子どもの個人情報を多く取り扱うため、子どもの個人情報・プライバシー保護法制度の充実が急務である。現在の法制度は、子どもの個人に関する情報を取り扱う場合、子どもの保護者の同意を必須とすることを中心としており、その同意を完全なものにすることで保護がなされるとしている。本研究では、このような保護者の同意中心の法制度が最適であるのか、EdTechを利用した教育の発展を妨げることなく、子どもの個人情報・プライバシー保護を実現する法制度はどのようなものなのかを明らかにする。

| Outline of Final Research Achievements |
The rapid expansion of EdTech has resulted in the collection and utilization of diverse data related to children. Legal frameworks for protecting children's personal information and privacy are predominantly based on parental consent. This study conducts a comparative analysis of the relevant legal regimes in Japan, the United States, and the European Union, highlighting the challenges inherent in consent-reliant models. It further examines practical issues arising in educational settings, variations in the meaning of “parental consent” across different jurisdictions, and the responsibilities of service providers concerning accountability and technical safeguards. Drawing on these findings, the study identifies key factors necessary to enhance the effectiveness of these frameworks and presents specific challenges and recommendations aimed at fostering international cooperation and harmonization in the design of legal systems.

| Academic Significance and Societal Importance of the Research Achievements |
本研究は、EdTech分野における子どもの個人情報保護法制を日本、米国、欧州で比較検討し、保護者同意中心の制度が抱える限界を明らかにした点で学術的な意義を有する。国際的な教育現場における実態と法的課題を体系的に整理することにより、我が国における子どもの個人情報・プライバシー保護法制度の今後の設計に対し、国際的な調和を目指した制度構築に資する知見を提供した。また、オンライン事業者にデフォルトで安全な設計を義務付ける必要性を示し、子どもの権利保護とEdTechの健全な発展を両立させる法制度の検討の深化に貢献した。
