本研究では、共謀のみ関わった者に正犯としての性質、すなわち共謀共同正犯が認められるのはどのような場合か、法哲学・言語哲学の分野で展開されている言語行為論やドイツ刑法典に規定されている申合せ罪をめぐる議論を踏まえて、立ち入った考察を加える。本研究を通じて、本来ならば教唆犯や幇助犯として軽い量刑で処罰されるべき者が共謀共同正犯として格上げされていないか、明らかにすることができると考えている。

| Outline of Final Research Achievements |
This research is designed to clear the standard of punishable conspiracy and the limits of conspiratorial co-principal from the viewpoint of the speech act theories. As a result of basic theoretical considerations based on the speech act theories and comparative legal considerations with Germany and Austria, I have found that when each person involved in a conspiracy establishes a kind of solidarity or communication relationship that interactional binds each other to achieve a specific worthless result and is aware of the real danger of causing a specific worthless result, even those involved only in the act of conspiracy can be punished as conspiratorial co-principal as long as the direct actor initiates the execution.

| Academic Significance and Societal Importance of the Research Achievements |
わが国の共犯事件では、関与者の9割以上が共同正犯して処罰されていると推察される。もっとも、共謀者の一部が犯罪を実行すれば、共謀にのみ加わった者も共同正犯として処罰されうる共謀共同正犯がどのような場合に成立するのかということは、これまで必ずしも明らかではなかった。共謀を言語行為論の観点から分析すると、共謀行為それ自体を実行行為そのものと評価されうる場合はあくまで限定的であるに過ぎない。本研究の成果を踏まえると、共謀共同正犯の成立範囲はこれまで以上に限定的なものとなるはずであり、共同正犯に代わり、教唆犯や幇助犯の成立可能性が広がることになる。
