Research Abstract |
Although the drafter referred to English cases in Hoten chosakai Minpo Giji sokkiroku, research on the influence of English Common Law on Japanese Civil Code has made little progress. In this study, I examine the conceptualization of what is called 'Independent Contractor' in the U.K. in order to elucidate the reason for drafting and purpose of Japanese Civil Code 716.
