Outline of Research at the Start

タイ憲法は，自然資源に係るコミュニティの管理・利用権と参加権を保障している。従来そのための具体的な法律は未整備であったが，2019年に水資源法とコミュニティ・フォレスト法が相次いで制定され，新法の具体的な執行方法が喫緊の課題となっている。
本研究では，新法の執行強化と改善のために，北タイの自然資源管理研究に実績のあるMae Fah Luang Universityと共同研究グループを組織し，①コミュニティの権利の内容と性質，②新法の到達点と課題，③コミュニティ参加型の管理組織と手続のあり方を検討し，自然資源をめぐる紛争の解決に向けた枠組みを提示する。

Outline of Annual Research Achievements

タイ憲法は，自然資源に係るコミュニティの管理・利用権と参加権を保障しているが，これまで参加を具体化する法律は未整備であった。これらの問題を改善するために，2019年から水資源法とコミュニティ・フォレスト法が相次いで制定され，現在，新法の具体的な執行段階に入っている。本研究は，①コミュニティの権利の内容と性質，②新法の到達点と課題，③コミュニティ参加型の管理組織と手続のあり方を検討し，新法の執行強化と改善に向けた具体策を提示することを目的とする。
今年度は，まず，Mae Fah Luang大学等，タイチームも交えた打ち合わせ・研究会を4回開催した。また，北タイ等において，複数のコミュニティ・フォレスト，水資源関連NGO，関係行政機関等を訪問し，森林管理および水管理に関する共同調査を行った。さらに，前年度に引き続き，コミュニティ・フォレストおよび参加型水資源管理に関する文献収集・サーベイを行った。そして，研究成果を英語の単行本として出版すべく企画を進め，出版社等との打ち合わせを行った。
これにより，森林管理については，①コミュニティ・フォレストに指定された地域においては，そのメリット，運営組織，具体的活動，②コミュニティ・フォレストの指定を希望しない地域においては，その理由，森林管理の手法等を含め，コミュニティ・フォレスト法制定後の北タイにおけるコミュニティ・フォレストの実態について，一定の知見を得ることができた。また，水管理についても，水資源への地域住民，NGOの参加の実態，水資源法制定後の変化等について，新たな知見を得ることができた。

Reason

北タイおよびラオスにおいて，コミュニティ・フォレストと水資源管理についてフィールド調査を実施できたことにより，研究は概ね順調に進んだ。しかし，水資源管理に関しては，政府による下位法令や計画の策定が必ずしも予定通りに進んでおらず，法律の履行状況の分析は限定的なものとならざるを得ない状況にある。また，コミュニティ・フォレストについても，水資源管理についても，その意義を評価するにあたり，コミュニティや先住民族の権利を保障している他国との比較の必要性を認識したが，その作業は緒に就いたばかりである。

Strategy for Future Research Activity

2023年度も，第１に，引き続き，タイの水・森林管理関係法令の収集・整理・分析を行う。第２に，2023度は北タイにおけるフィールド調査を行ったが，法律制定から数年が経過したこともあり，全国レベルでの法律の執行状況について，国レベルの関係行政機関のヒアリング等により，把握・分析する必要がある。第３に，これらタイ国内の制度の研究に加え，ラオス等，メコン流域諸国やメコン委員会を含む関係国際機関における参加原則の動向についても文献調査を行い，地域的特徴や課題の明確化作業を継続する。第４に，ASEAN以外の地域にも，コミュニティの権利を保障し，コミュニティ参加型の資源管理を強化する国が増えてきていることから，可能な範囲内で，台湾，ニュージーランド等，参考になりうる国の制度・実態について文献調査を行い，必要に応じフィールド調査を行う。
