Outline of Research at the Start	近年、子に対するしつけを名目とした体罰・虐待が社会問題化し、児童虐待防止法等の法改正がなされ、体罰が禁止されるに至った。しかし、刑法分野では子に対する措置の正当化の範囲・理由について、現在の社会情勢に適した議論がほとんどなされていない。本研究は、教育学等の関連する諸領域を参照にしつつ、子に対する措置を許容する法令の趣旨、実際に子に対する措置によって保護される利益及び害される利益等を分野横断的に分析・検討することにより、子に対する暴行罪・傷害罪等の構成要件該当行為の違法阻却の判断における考慮要素の指針を提案し、児童の権利を侵害しうる大人の措置の違法性に関する理論の基礎を築くことを図るものである。
