| Outline of Research at the Start |
近年の憲法学では、ドイツ法学由来の「ドグマーティク」概念への注目が高まっているが、その意義と課題は必ずしも共有されてこなかった。さしあたりドグマーティクとは、法実務家の法適用の補助を志向する、体系的な法的概念を構成する狭義の法学と解され、法解釈のインフラストラクチャーとして法的安定性の確保に貢献する。しかし、その理論的検討は実はドイツでも不十分であり、様々な問題点も指摘されている。
本研究は、ドグマーティクに内在する法理論上の問題点の検討を通じて、ドイツ憲法学におけるドグマーティクの方法の可能性と限界を明らかにし、その方法がわが国の憲法学にどの程度共有し得るか把握することを目的とする。

| Outline of Final Research Achievements |
In order to clarify the possibility and limit of “legal dogmatics” (Rechtsdogmatik) in German constitutional scholarship, this research followed its research trends since the second half of the 2000s, when the methods of constitutional scholarship were actively reviewed, and examined its theoretical problems and the environment in which the discipline is situated. The legal concepts constructed by legal dogmatics enable stable legal argumentation by being cyclically reproduced between jurisprudence and legal practice. However, in legal dogmatics, there is a risk that opportunities to reflect on its activities and knowledge of the foundational subjects are structurally lost. Therefore, it is necessary to incorporate interdisciplinary and intradisciplinary perspectives in research and education. Through this research, the basic understanding of German constitutional law and the intellectual foundation to reexamine the method of constitutional scholarship in Japan was obtained.

| Academic Significance and Societal Importance of the Research Achievements |
本研究をつうじて、いまだ日本で不明瞭な概念である法ドグマーティク（法解釈学）の可能性と限界を明らかにし、それによってドイツ憲法（学）の基本的前提を学界に共有し、日本における憲法学の方法を再検討する知的土台を獲得することができた。憲法学の方法・対象・課題は国や時代で実際には大きく異なるが、本研究ではドイツ憲法学に特徴的な法ドグマーティクの方法を照射し、その法実務との近さの所以を制度的な背景（憲法裁判所、法曹養成教育、出版媒体）にまで遡って考察したことで、法適用者の法的実践を合理化し法的安定性を保障するという、民主的な立憲国家で憲法学が果たすべき社会的役割を摘示した。
