Outline of Research at the Start	本研究は、裁量信託をめぐるアメリカ法の判例、制定法、リステイトメント、学説等を参考に、①裁量信託の受託者の裁量権濫用の基準およびその判断要素は何か、②受益者の一般債権者が、裁量信託における受益権に対する差押え等の強制執行を認められるのはいかなる場合か、③裁量信託の受託者が、その裁量権にもとづいて受託者のみの意思表示により信託を変更することができるのはいかなる場合か、という法的問題点について、関連する民法上、民事執行法上の理論および信託の実務を踏まえたうえで、総合的かつ多面的に検討するものである。
