| Outline of Research at the Start |
本研究は、暗号資産やトークンに担保を設定する法制度が資金提供者・調達者（法制度の利用者）の状況や需要を受け止め、利用者にとって明瞭で活用しやすいものとなることを目指し、日仏での文献調査や聞取り調査によって行われるものである。
以上は、無体の財がどのように活用されるべきかを理論的に検討しながら、その前提として、暗号資産やトークンのような新たな財に対し、どのような法的支配を及ぼすかという側面から光を当てることで、これらの法的性質論にも影響を及ぼす。
また、本研究は暗号資産やトークンの活用しやすい法制度を設計するものでもあり、日本のデジタル産業の基礎となる金融面への現実的な影響も見込まれる。

| Outline of Final Research Achievements |
This study focuses on new assets composed of blockchain (particularly crypto assets and NFTs). Specifically, it addresses methods for collateralizing such assets and related issues. The research methodology involves literature reviews and interviews in Japan and France. The results of this study suggest the potential for utilizing these new assets for funding and financing.

| Academic Significance and Societal Importance of the Research Achievements |
まず、ブロックチェーンを用いる暗号資産やNFTは電子的に権限を示す点で本質を共通とすることを明らかにし、本研究はこれらについて共通の法的検討の視座を示す意義を有する。この視点を前提とすれば、同じように電子的記録で権限を示し、その帰属や他者への移転を実現し、さらに、担保化や第三者保護まで法制度化されたものとして、振替株式が存在しており、この法制度を暗号資産やNFTに類推適用することが可能かつ有益であることを日仏の比較研究で示した。このことで本研究は、暗号資産やNFTの担保化が振替株式の担保化手法を参照可能であるとの法的道筋を示し、これらを資金提供・調達に用いる可能性を明確化する意義も有する。
