Outline of Final Research Achievements |
First, by close study on Oliver Wendell Holmes, Jr. "Common Law" Chapter 6 'Possession', I analyzed what kind of Legal theory Holmes proposed in order for states to regulate private transactions from the competition policy in the late 19th century American jurisprudence when classical legal thought based on natural law thory flourished. Second, I examined Dr. Miles Medical Co. v. John D. Park & Sons Co., 220 U.S. 373 (1911), especially dissenting opinion by Holmes. By this examination, I clafiried how Holmes realized his legal thory as a Judge. I also found out contemprary significance of his dissenting opinion.
