Outline of Research at the Start

今日のインドネシアにおいて国土の65％を占める政府指定の森林地域には5000万人の住民が住み、多くは必要な政府許可を得ていない。1960年土地基本法は、土地権は慣習法に基づくと規定している。また、多くの土地は未登記で住民は土地証書を持たない。本研究は、①慣習法に基づく土地権の実態とは何か。②土地権の不確定状況がうまれた経緯を、国有地（植民地期）と国家管理地（独立後）との関係史から明らかにする③スハルト大統領退陣・改革後の諸政策のこれら問題への影響を明らかにする。住民の土地権が不確定であるという喫緊の問題を分析し「慣習法に基づく土地法制度は可能か」と問い、インドネシア慣習法研究に革新をもたらす。
