Outline of Research at the Start

本研究の核心的問いは、「生存配偶者の法的保護は、どのような形式で、どのような機能を果たすか」であり、それは同時に「生存配偶者のための用益権・居住権は、いかに語られ捉えられてきたか、そして今後いかに語るべきか」でもある。
明治民法起草者が意識的に拒否した、寡婦への一身専属的「用益権」は、西欧諸国では活用されており、我が国でも改正民法で新設した「配偶者居住権」がこれに相応する。
このように、家族観は立法へも反映されることから、相続法制が家族の在り方や相続実務に与えた影響を実証的に検討し、学際的統合シンポジウムを開催して、相互参照した書籍を刊行する。
