Outline of Research at the Start	本研究の問いは、認知制度の基礎にある利益衡量は何か、何であるべきか、そこに社会福祉的観点・要請は含まれるのか、である、つまり、認知制度の趣旨を社会福祉的な観点から再検討する。そもそも認知制度は、困窮する妊婦及び子の利益保護という個別状況に配慮した福祉的要請も利益衡量の対象としてた。そこで、従来のやや法的要請に純化されすぎた衡量要素のみならず、子の誕生場面の状況に即した利益への配慮を含めた形で、認知制度で配慮すべき利益及び衡量の仕方を再検討する。その際、認知制度を広く非嫡出子問題の文脈に置きなおし、そこでの利益衡量の幅を広げることで、認知制度をその果たすべき社会的機能の観点から検討する。
