Outline of Research at the Start	本研究は、性的マイノリティの権利・平等に関して、ドイツの連邦憲法裁判所の判例分析、ドイツの学説分析、ドイツの法制度の分析を中心に、憲法学の観点から研究するものである。日本において性的マイノリティの権利について憲法学の観点から検討し、具体的な解決策を提案しなければならない状況にある。そこで、該当する権利に関する判例及び学説の蓄積のあるドイツ憲法学を検討し、日本の判例・法制度と比較する。これにより、比較法学・憲法学の観点から、日本における性的マイノリティに関する現行制度の問題を明らかにし、司法の救済方法の是非・制度の在り方など差別問題の解決方法に対する具体的な提案を示す。
