Outline of Research at the Start

偽情報やヘイトスピーチが跋扈する昨今のSNS環境においては、「悪しき言説は自由な言論の応酬によって淘汰される」という憲法学の想定は妥当しない、という見方が支持を集めている。かかる状況を背景に本研究は、言論空間を「理想状態」に近づけることを目的として国家が行動することの可否および適否について検討する。直接規制のほか、デジタルプラットフォーム事業者の自主規制を誘導する共同規制的手法の許容性と限界とを、「思想の自由市場論の見直し」という切り口から理論的かつ具体的に探る。
