Outline of Research at the Start

デジタル財の法的性質・取扱いは明確でなく、特にコンテンツデータ（著作権の対象）と関連付けられたNFTを自然人が発行する事例で、その法的性質に関する諸説を比較しながら、財の活用終了時の問題を解決し得るか（ひるがえって、その解決基準を導く法的性質決定の妥当性はあるか）を考察することが、本研究の目的といえる。これはデジタル財の活用が盛んで、日本法とのつながりも有するフランス法から示唆を得るべく、日仏比較法の手法で行うものであり、資源の乏しい日本がデジタル領域で成長するツール（デジタル財）に関する法制度の明確化を図るものである。なお、以上は無体財の法的性質という理論面に加え、社会への影響も見込まれる。
