研究成果の概要

本研究課題は信託制度に内在する実績配当主義の原則について金融機関論と金融制度論の立場から考察している。具体的には信託の実績配当主義をその金融仲介との関連で分析し、さらに信託制度の機能の一部として把握することを主眼として、信託行為が有する（特にリスク負担機能にとっての）意義、信託における分権的意思決定の形成、信託の所有権の構造など、信託に固有な論点をこの原則との関連で考察したうえ、実績配当主義を有する信託が異なるリスク選好を有する経済主体の間で社会的リスクシェアリングの機能を果たすことを理論的に明らかにした。併せて信託制度が金融システムにおいて有する役割の一端をこの機能に基づいて解明している。
