研究実績の概要 |
Much time has been devoted to an overview of the literature addressing: 1) Theory and practice of legal education, with a focus on the development of clinical legal education and 'environmental clinics' in East Asia; 2) Theory and practice of interdisciplinary education and research in the environmental field of knowledge, with a focus on transdisciplinary case-based education; 3) Law in/and the Anthropocene, with a focus on transnational environmental law scholarship. I have made public presentations at an early stage: 1) 'Cross-Border Skills Education in Environmental and Natural Resources Law as a New Field of Expertise in Asia', IDE-JETRO, May 24, 2016; 2) 'Looking Forward: A New Approach to Climate Justice for Climate Disaster Law', Keio University, SFC, August 3, 2016. I have published one chapter addressing the development of case-based legal education in Japan (I. Giraudou, "L'enseignement du droit par cas au Japon: une formule pedagogique du droit global?", in M.-C. Ponthoreau, La denationalisation de l'enseignement du droit, Paris, Fondation Varenne, p. 232-254); I have also finalised one working paper reflecting on the competence-based approach to legal education in Japan (I. Giraudou, "Quelle formation pour quels juristes au Japon? La question des capacites professionnelles visees par les professeurs de droit dans leurs pratiques d'enseignement"; online: https://hal.archives-ouvertes.fr/hal-01408193v2; to be published later this year as a chapter in a collective book). Finally, I have started to develop various research collaborations in Japan and overseas.

理由
My research is progressing rather smoothly. In fact, after a necessary period of adaptation to my new professional environment (from Nagoya University to the University of Tokyo, where I am associate professor), I have decided to take this unique position as a precious opportunity to refine further one specific dimension of my research project. Now affiliated to the Organisation for International Programs on Environmental Sciences at Tokyo U., Komaba, I seek to reflect more in depth on the significance of disciplines in contemporary higher education by raising three questions in particular, that all concern legal education in the environmental field in East Asia : 1) Is it best to address internationalisation of university education within the academic context of the disciplines or outside these discourse communities? 2) How is the 'Anthropocene' narrative progressively permeating Legal Studies? 3) How could environmental leadership capacity building in higher education and transdisciplinary case-based education deal with ‘legal reasoning in context’ (raisonnement juridique en situation) as a key competence? At this stage of my reflection on such issues, joint educational activities and weekly discussions with colleagues from different nationalities and various disciplinary backgrounds (for example through the Global Faculty Development at Tokyo U. Komaba) have helped me to refine significantly the research hypothesis and have provided me with a number of original insights it certainly could have been difficult to get from law faculties' circles.

今後の研究の推進方策 |
I. The overview of the literature will be complemented, based on a number of books received recently that deal with two related subjects, namely: interdisciplinarity in higher education and 'Law in the Anthropocene' as a new field of research. II. As affiliated to the Organisation for International Programs on Environmental Sciences at Tokyo U., Komaba, I have already started and will continue to reflect on the possibility to develop innovative teaching methods and interdisciplinary curricula. More particularly in relation with the activities conducted by its Global Faculty Development, I plan to organize an international workshop on transdisciplinary case-based education in the environmental field of knowledge. III. Drawing on existing networks (such as Bridges Across Borders Southeast Asia Community Legal Education Initiative, the Asian Judges Network on Environment, the Asian Environmental Compliance and Enforcement Network, etc.), I plan one research trip (Indonesia, Malaysia and Singapore), I will gather complementary information concerning both the possibility of creating a case study database on a regional basis and on the ‘good practices’ developed so far in clinical legal education through collaborations existing in and between these jurisdictions. IV. I plan to present the main features of this research project (working hypothesis and preliminary findings) in two peer-reviewed articles, respectively in French and in English.

次年度使用額が生じた理由 |
The research trip initially planned for fiscal year 2016 had to be cancelled due to changes in my academic affiliation. In addition, the books order I have placed at one university book center has not been properly managed, this causing much trouble and important delays. After cancellation, this books order has been transferred to another provider, based at Tokyo U. Komaba, this allowing now for a smooth process.
