| 研究概要 |
第2年度に入り、収集文献および資料の精査と分析が加速度的に進みつつある。とりわけ、国際立憲主義に関連する理論構築において大きな成果を上げた。文献的には、昨年度実績報告に掲げたもののほか、Erika de Wet, The Chapter VII Powers of the United Nations Security Council (Hart Publishing, 2004), Antonios Tzanakopoulos, Disobeying the Security Council: Countermeasures against WrongfulSanctions (Oxford U.P., 2011), Jeffrey Dunoff et. al., Ruling the World: Constitutionalism, International Law, and Global Governance (cambridge U.P., 2009), Nico Krisch, Beyond Constitutionalism: The Pluralist Structure of Postnational Law (Oxford U.P., 2010) などをとりわけ精査の対象とし、加えて膨大な数の雑誌論文を検討して、この面の進捗は計画以上に順調に進んでいる。
この間、2012年4月には国際法教会日本支部において学会報告を行い、同6月にはアジア国際法学会日本協会研究大会において国際立憲主義セッションでモデレータを務め、活発な議論を引き出した。また、9月にはスペインで開催されたヨーロッパ国際法学会に出席し、関連研究者たちと意見交換し、今後の研究の深化につなげた。
