本研究は、リニエンシー・プログラムの有効性に焦点を当てた。リニエンシー・プログラムはカルテルに対して競争法を施行する最も強力な制度として執行機関の強い支援を受けたが、考慮すべき点がいくつかある。リニエンシー・プログラムはカルテル活動を抑止できない可能性がある点である。言い換えれば、リニエンシー・プログラムがあるにも関わらずカルテルは形成されるのである。カルテルが海外で摘発された場合を除けば、リニエンシー・プログラムはカルテル参加者の一つを罰することにすぎない。しかし、ここにおいてリニエンシー・プログラムは、執行機関が違法なカルテル活動の証拠を入手する手助けになり得る。
