Research Abstract |
In this research, a lot of the books on criminal justice in Italy are analyzed, being focused to so-called `causa dionore (causa honoris)" articles of Italian Criminal Code (1889). For examples, F.Carrara, Programma del corso di diritto criminale ; ibid., Pensieri sul progetto di codice penale Italiano del 1874, and the so-called "Italian school"(positivists), especially C.Lombroso, "Troppo presto" (in Appunti al nuovo codice penale, 1888) ; ibid., La donna delinquente: la prostituta e la donna normale, also the many books of E.Ferri, R.Garofalo, S.Sighele, and so on. Then, the codification process of the Code is analyzed through the documentations of the Parliaments. The protagonists were G.Pisanelli, P.S.Mancini, E.Pessina, P.Ellero, and G.Zanardelli.
