Research Abstract |
In order to carry out this project, I mainly did the following; collection and analysis of jurisprudence of treaty bodies (including the European Court of Human Rights), as well as judgment of Japanese Court. I also surveyed court practice of some countries and collect other relevant materials in this regards. In analyzing these materials, I divided the issues into three areas; entry of aliens into a country, stay of aliens in that country and forced departure of aliens from that country. I also collected some other relevant materials in Geneva (particularly participating in meetings in the International Law Commission as a advisor of Japanese Commission member) and New York. The results of this project was published in my papers on various theme, including “ deprivation of liberty of asylum seekers in Japan," “ analysis of the judgment of the European Court of Human Rights in the case of Rodrigues de Silva and Hoogkamer v. the Netherlands," and “deportation and the protection of family." Now I am preparing a article on Japanese court practice on special permission of stay in deportation procedure and International Human Rights Law which will be published in due course.
