| Research Abstract |
研究第2年目に当たる平成19年度は,本研究の中核的部分である次のような作業を行った.
1 海上物品運送法制をめぐる実態調査として次のことを行った.
(1)運送人の責任限度額の変更がもたらしうる経済的なインパクトに関する調査.
(2)船荷証券の受戻証券性をめぐる問題点に関して,金融機関の観点からの意見を聴取し,その緩和のもたらすインパクトを調査した.
2 外国法制等の調査
複合運送に対する国際道路運送条約(CMR),国際鉄道運送条約(COTI-CIM)の適用関係を調査し,海上物品運送条約がdoor to doorに適用される場合の条約間の衝突問題について調査分析した.
3 成果公表の準備
以上のような研究に加えて,研究成果の公表のための準備にも着手した.若干の研究成果の公表(特に国際的な公表)を行うとともに,The Texas International Law Journal, the United States Department of State, & the Maritime Law Association of the United States主催の国際シンポジウム"Transport Law for the 21st Century: The New UNCITRAL Convention"(March 27-28,2008)において,"Performing Parties and the Multimodal Implications of the New Convention"と題する報告を行った.その原稿は年内にThe Texas International Law Journalに掲載されるが,同時にUNCITRALの新国際物品運送条約の英文体系書(共著)の一章をなすものである.
