Outline of Final Research Achievements

The results of this research have three points. ① I elucidated the theoretical structure of liberal theory of human rights, which legitimizes neoliberal government and makes resistance to it difficult. ② I made it clear that the postmodern human rights theory that constitutes the foundation of British critical legal studies is conceived as practical movement toward the "Idea of communism," and that the concepts of the right to resistance/revolution and axiomatic equality lead this conception. ③ I concluded that a postmodern human rights theory mainly based on the right to resistance/revolution and axiomatic equality is indispensable as a strategy against neoliberalism, which dominates the legal and political situations in many countries including Japan, and that we should deal with exclusionism and poverty issues through social solidarity derived from this theory.

Academic Significance and Societal Importance of the Research Achievements

本研究成果の学術的意義は、リベラリズムの人権リストから削除された抵抗／革命への権利を甦らせ、実質的な平等を前提とする公理的平等論を人権論として位置付けた点にある。これにより、ネオリベラルな統治によって無力化された従来の普遍的人権の観念を再定位することが可能となった。この新たな人権論により、市場至上主義的な統治政策への抵抗と体制変革へと向かう途が示された。脆弱な人々の社会的連帯を通じて、労働、教育、医療、福祉、環境といった一連の社会課題を解決へと導くポストモダン人権論の構築には、特に深い社会的意義を認めることができる。
