| Research Abstract |
本研究は、私人や私企業に対して外国が損害をもたらした場合に生ずる「私人・私企業対外国国家」型の紛争を処理するためのさまざまな手続(例えば、私人の本国における国内裁判、私人の本国と外国との間の国際的手続(外交的保護))について、外国に対する私人・私企業の利益の救済という共通の目的や手続間の相互連関に着目することにより、「私人・私企業対外国国家」型紛争の処理に関する国際法という枠組にまとめ、その現代的構造と問題点を明らかにしようとするものである。
