Research Abstract |
This Research aimed at elucidating 'Freedom of the human body' that the constitutional theory neglects.As a result,it become clear that 'Involuntary servitude' (art.18) is limited to a thing unbearable under normal social conventions,that Art.31 means the basic rule of Legal procedure,that Republicanism cannot justify Lay judge system under present Japanese constitution.
