Outline of Final Research Achievements |
This study aimed to analyze the effectiveness of parliamentary oversight over the Intelligence Community (IC) in Japan, focusing on the Board of Oversight and Review of Specially Designated Secrets (BOR) established in 2014. This study conducted a comparative analysis of similar systems in the five major Western countries. Based on the analysis of the legal authority granted to the boards and their actual activities, the study concludes that Japan’s current BOR system is still inadequate compared to similar systems in the other countries mentioned above. One of the reasons for this gap is the limited legal authority granted to the boards. However, based on the institutional design of the BOR system and its actual activities, some aspects can be evaluated positively, such as its contribution to the improvement of intelligence literacy in the Diet, which can help establish a more effective and comprehensive body for parliamentary democratic control over the IC in the future.

Academic Significance and Societal Importance of the Research Achievements |
各種の高度科学技術の発達を背景に、近年、日本のインテリジェンス機構(IC)はテロ対策やサイバーセキュリティ等の名目で権限・体制等の強化を図っている。しかし、世論の中にはこうした動向に対する懸念もある。かかる課題に対し、欧米諸国等ではインテリジェンス機関に対する監視機関の設置等により対処が図られている。今後、日本においても同種の制度の導入に向けた議論が高まる可能性もあるが、先行研究等は乏しい。こうした状況を踏まえ、本研究は「日本のICに対する民主的な監視制度の今後の具体的な在り方の解明」を目的とする。当該研究により、民主主義社会における「安全と権利自由の両立」の実現に貢献し得ることが期待される。
