| Academic Significance and Societal Importance of the Research Achievements |
本研究の学術的意義は、戸籍先例・判例実務に基礎を持つ推定の及ばない子法理及び民法実親子規定を戸籍制度の実体的基礎の観点から包括し、嫡出推定制度の理論的課題を明らかにしたこと、及び、無戸籍者問題への対応策として、推定の及ばない子法理の射程を再検討し、あわせて、令和4年改正過程でも検討された出生届の段階で嫡出推定規定の適用外を認める方策について理論的・政策的考察を加え、将来の立法可能性を検討したことにある。
